Civil Enforcement Policy
The Civil, Family, Tribunals and Administration of Justice Directorate is recruiting permanently for an SEO Policy Advisor to work on Civil Enforcement Policy.
This campaign is open to all staff within the Ministry of Justice and is available on level transfer and for suitable candidates for substantive promotion.
Candidates are reminded that to be eligible for this campaign; you must still be employed by the Ministry of Justice as a civil servant at the point of accepting the role. If you resign or your FTA contract ends before you are made and accept an offer, you will become ineligible and you will be withdrawn from the process.

The Work of the Civil Enforcement Team
The Civil Enforcement team sits in the Civil Justice and Law Policy Division (CJLP). The CJLP team is a friendly and supportive division which oversees a varied policy portfolio, ranging from housing, to wills and inheritance, to personal injury and strategic litigation. The division works to protect and modernise the civil justice system to ensure it is fair, proportionate and provides equitable access to justice. We work with colleagues across MoJ to ensure civil law meets the needs of the UK in the 21st century, as well as working routinely with a huge variety of cross-government and external stakeholders (including HMCTS, other government departments, the civil judiciary, the legal profession, business, the enforcement industry and the third sector).
The Civil Enforcement Team is responsible for policies to provide claimants with effective enforcement processes, whilst ensuring that those facing enforcement action are treated fairly. Their work is currently focused on the regulation of private enforcement agents (also known as bailiffs), as well as policies governing court-based enforcement of civil money judgments and possession orders.
The Civil Enforcement team currently comprises of two other SEOs and one EO, all working to a G7 team leader. We are a friendly and motivated team who support and look out for each other and work collaboratively in a complex area.
The postholder will benefit from broad policy development, taking forward legislation and implementation opportunities, and insight into a technical area of policy that fundamentally underpins the administration of civil justice. Areas of priority for the Government include:
- Improving private enforcement agent regulation. The Ministry of Justice supports the work of the Enforcement Conduct Board (ECB), which provides independent oversight of enforcement firms to ensure everyone facing enforcement action is treated fairly. The Government has made a commitment to put it on a statutory footing.
- Working with HMCTS to identify further options for reform, to ensure that court enforcement methods are effective, efficient and fair, as well as transforming and digitalising processes in the County Court to modernise the court system.
- Working across government to ensure that the enforcement system can deliver government priorities, for example, supporting the Ministry of Housing, Communities and Local Government (MHCLG) to take forward tenancy reforms, which includes the enforcement of evictions.
This is important, sometimes controversial, work in the Civil Justice system, with significant consequences for all those associated with enforcement action. There is strong stakeholder interest in this policy area, as we seek to balance the need to provide creditors with effective and sustainable enforcement options, whilst ensuring that those facing enforcement action, particularly vulnerable people, are treated fairly.
Senior Policy Advisor on Civil Enforcement - the role
The post holder will need to work alongside operational, legal and analytical colleagues to develop and implement complex policy reforms. These might require primary and secondary legislation. You will also work closely with HMCTS, the judiciary, the ECB, the enforcement trade and professional associations and the debt advice sector. Civil enforcement is also important to the work of other departments, and you will need to engage with colleagues across government to ensure that policies are aligned.
Main Activities / Responsibilities
1.Management and delivery of workstreams to improve the regulation of the enforcement industry, working closely with other team members and legal colleagues to develop and implement reform.
2.Development and delivery of legislative amendments required to digitalise the County Court, working closely with operational, legal and digital colleagues.
3.Working across government to ensure that the enforcement system can deliver government priorities and to ensure the strategic alignment of policies.
4.Oversight of the entire civil enforcement policy portfolio, supporting the G7 team leader as necessary.
5.Responding to correspondence, Parliamentary Questions and Freedom of Information requests.
6.Supporting the wider CJLP policy team by engaging with departmental business and corporate activities.
Skills and Experience
The successful candidate will need excellent policy and communication skills and to be able to develop and maintain relationships with a diverse range of stakeholders. They must also be able to provide high quality and evidence-based policy recommendations and briefing to Ministers.
The postholder must be able to demonstrate the following skills and experience:

- Experience of developing and implementing policy.
- Strong written and verbal communication skills, including the ability to understand and convey complex information and ideas clearly and concisely.
- Experience of building effective working relationships with a range of stakeholders
- Strong organisational skills and proven ability to deliver at pace.
- Ability to manage competing priorities and work independently.
Desirable:
- Understanding of the Civil Justice system.

Working Arrangements & Further Information
The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.
Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.
For nationally advertised roles: All successful candidates will be appointed to the nearest viable office nearest to their home postcode and on its respective pay scale. This will be at either a HQ building (subject to desk allocation, a Justice Collaboration Centre (JCC) or a Justice Satellite Office (JSO) – See Map . All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity).
For current MoJ employees, your base location will need to be changed to the nearest viable office (to your home postcode), either at a HQ building, JCC or JSO within the National Office Network and moved its location’s respective pay scale (any legacy arrangements/locations will need to be amended).
Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.
MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.

Flexible working hours
