COMPLIANCE INVESTIGATOR  
(This role is based in Brazil)

PURPOSE AND SCOPE:

Under the general direction of the VP Global Head of Compliance Investigation, this position assists with the development, implementation, and continuous monitoring of an enterprise-wide Compliance Investigations Program and leads the Company’s Compliance Investigations for all Business Units and Corporate functions.

Supports FME mission, vision, core values, and custom service philosophy. Adheres to the FME Compliance Program, including following all regulatory and company policy requirements. Collaborate with the appropriate personnel on selected Compliance related projects and processes.

PRINCIPAL DUTIES AND RESPONSIBILITIES:

- Independently leads and conducts compliance investigations, including, but not limited to, assessment of allegations, review of relevant documents, witness interviews and written summaries of same, analysis of facts, and preparation of investigation reports.
- Conduct forensic analyses on a variety of source data in the context of fraud, embezzlement, corruption or money laundering investigations to come up with analytically sound findings which you can translate to a non-financial audience.
- Independently conducting fact-finding and interviews with both junior and senior-level employees, preparing concise and factual investigation reports and ad hoc briefing documents, advising on appropriate remedial actions as well as monitoring the implementation of these in response to investigations
- Develops and maintains effective relationships through effective and timely communication.
- Adheres to Compliance Investigation work plans and protocols, assembles and manages the necessary internal and external resources, and conducts the investigation in compliance with protocols.
- Provides timely reports, both orally and in writing, to the Global Head of Compliance Investigations and/or senior management regarding the status of investigations.
- Provides input into investigation best practices and recommendations for continuous improvement to the Compliance Investigation Program.
- Collaborates with other departments, including the Finance, Human Resources, and Patient Care on investigations and the investigation process.
- Maintains current knowledge of laws, regulations and market changes that impact all aspects of the business, including, but not limited to, FCPA, Stark Law, Anti-Kickback Statute, Patient Inducement Statute, Health Insurance Portability and Accountability Act, relevant Office of Inspector General, Model Guidance, and applicable advisory opinions.
- Complies with the Code of Business Conduct and all applicable company policies and procedures, local, state and federal laws and regulations while maintaining the highest degree of personal ethics and integrity.
- Assist with various projects assigned by Head of Global Compliance Investigations.
- Other duties as assigned.

EDUCATION:

Bachelor’s Degree required, Masters or JD Degree preferred

EXPERIENCE AND REQUIRED SKILLS:

- Minimum 2-4 years’ work experience handling investigations for a large, complex organization.
- Must have demonstrated ability to manage and conduct significant investigations with internal and external resources, including employee and third-party interviews and to advise senior management on investigation related issues.
- Demonstrated ability to develop appropriate detailed Investigation Work Plans and to devise appropriate scope for electronic data/documents searches.
- Knowledge of the healthcare industry, dialysis industry, or Fresenius Medical Care desirable.
- Superior ability to communicate orally and in writing to individuals and groups from varied disciplines and levels of management.
- Excellent analytical, problem-solving and organizational skills required.
- Ability to maintain confidentiality and comply with applicable privacy and security rules and regulations, including HIPAA.
- Technical skills: proven experience with enterprise software and tools (e.g. SAP), MS office (e.g. Excel, PowerPoint) and, ideally, with investigation tools such as eDiscovery platforms (Relativity).
- Fluency in English, additional language skills (Spanish, Portugues) are an advantage.
- Ability to work a flexible schedule.
