Senior Wage-and-Hour Litigation Attorney

MHS is seeking a Senior Employment Litigation Attorney with significant experience defending employers in wage-and-hour litigation, including class and collective actions. This role is ideal for an attorney with substantial hands-on experience handling complex employment litigation and taking a lead role in litigation strategy, case management, discovery, briefing, and client counseling. The ideal candidate has developed meaningful expertise in wage-and-hour, class and collective action defense and can independently manage sophisticated matters.

Responsibilities

- Lead and manage the defense of FLSA collective actions, PAGA, and/or related wage-and-hour litigation

- Develop case strategy from initial assessment through resolution, including early risk analysis and settlement strategy

- Draft significant motions, including motions to dismiss, motions for summary judgment, and motions relating to conditional certification, decertification, and class certification

- Manage complex discovery, including large-scale document productions, ESI issues, written discovery, and depositions

- Take and defend depositions of plaintiffs, corporate representatives, experts, and other key witnesses

- Work closely with clients to understand business operations, compensation practices, timekeeping systems, and other issues relevant to wage-and-hour litigation

- Manage experts and analyze damages, payroll, timekeeping, and other complex data

- Participate in mediations, settlement negotiations, and trial preparation

- Provide advice to clients regarding wage-and-hour compliance and litigation risk

- Supervise and mentor more junior attorneys and help efficiently staff and manage matters

- Collaborate with attorneys across the Firms national Labor & Employment practice

Salary: $190,000 - $300,000 depending on experience.

Qualifications

- JD from an ABA accredited law school and active membership in at least one state bar

- 5+ years of wage & hour litigation experience

- Strong working knowledge of the FLSA, PAGA, and wage-and-hour laws

- Exceptional legal research, writing, and analytical skills

- Meaningful deposition and complex discovery experience

- Ability to independently manage sophisticated litigation matters and competing deadlines

- Strong judgment and the ability to communicate complex legal and business issues clearly to clients

- Experience working directly with corporate clients, in-house counsel, and senior business leaders

- Strong organizational and project-management skills

- Collaborative, practical, and client-service focused approach
