About this role

About BYD

BYD is one of the world's leading manufacturers of new energy vehicles (NEVs), dedicated to driving sustainable mobility solutions across global markets.

As BYD continues to expand in Australia, we are establishing BYD Financial Services Australia, our captive finance business, to provide tailored automotive financing solutions to BYD customers and dealers.

About the Role

We are seeking an experienced Senior Credit Risk & Compliance Manager (Responsible Manager) to play a key role in establishing BYD Financial Services Australia.

This is a unique opportunity to help build the credit risk, compliance and governance frameworks of a new automotive finance business from the ground up.

You will work closely with our appointed external legal advisers to support licensing applications, develop credit and compliance policies, and oversee the performance of our existing white-label finance portfolio. As the business transitions towards lending under its own licences, you will provide independent oversight of retail and wholesale lending activities.

The successful candidate will bring strong Australian consumer or automotive finance experience, sound regulatory knowledge and a hands-on approach to building and managing risk and compliance functions.

Key Responsibilities

- Credit Risk Framework & Portfolio Oversight

- Develop the company's credit risk framework, risk appetite statement and credit policies, including responsible lending standards, for approval by the directors.

- Design end-to-end credit processes covering application assessment, automated credit decisioning, delegated credit authorities, arrears management, hardship, collections and recoveries, including balloon payment and guaranteed future value products.

- Establish the dealer wholesale and floorplan credit framework, including dealer credit assessments, credit limits, periodic reviews and risk ratings, in preparation for wholesale lending operations.

- Monitor the credit quality and performance of the existing white-label finance portfolio using partner-provided data and prepare monthly reports for senior management.

- Regulatory Compliance & Framework Development

- Monitor regulatory developments and guidance from ASIC, AFCA, AUSTRAC and the OAIC, assessing their implications for business operations, products and processes.

- Develop and implement the compliance framework, including the regulatory obligations register, compliance monitoring plan, breach reporting within 30 days, incident management, complaints oversight and annual compliance certification requirements.

- Work with appointed external legal advisers to establish AML/CTF arrangements, privacy and credit reporting procedures, internal dispute resolution processes, AFCA membership and target market determinations, where applicable.

- Maintain comprehensive documentation and evidence demonstrating the design, implementation and ongoing effectiveness of regulatory compliance frameworks.

- Governance, Reporting & Stakeholder Management

- Prepare and present risk and compliance reports to senior management and the directors, with direct access to the Audit & Risk Committee Chair once established.

- Establish and manage the risk and compliance function as a hands-on individual contributor, with the opportunity to build the team as the business expands.

- Develop and deliver compliance and responsible lending training for employees and, in collaboration with the Sales team, dealer partners.

- Collaborate with BYD Group's risk and compliance teams to ensure policy alignment while maintaining appropriate independence from commercial operations.

- Licensing & Responsible Manager Responsibilities

- Serve as a nominated Responsible Manager for the company's Australian Credit Licence (ACL) application and Australian Financial Services Licence (AFSL) application, where required, and fulfil applicable ongoing regulatory responsibilities.

- Support compliance with ASIC's organisational competence and fit and proper requirements, including maintaining the necessary knowledge, skills and availability, and promptly disclosing any matters that may affect suitability for the role.

- Lead the preparation and coordination of ACL and, where required, AFSL applications in collaboration with appointed external legal advisers, including business, operational and supporting documentation.

- Act as the primary day-to-day contact for external legal advisers, managing project scope, fees, regulatory requirements and key licensing milestones.

- Coordinate with internal stakeholders across Operations, Finance, Risk, Compliance and Management to obtain required information, resolve application-related matters and respond to ASIC enquiries.

- Future Responsibilities (Following Business Launch)

- Provide independent second-line oversight of retail and wholesale lending activities once BYD commences lending under its own licences, with operational credit decision-making transitioning to the Operations team.

- Chair the Risk & Internal Controls Committee and provide regular reporting to the Audit & Risk Committee.

Key requirements:

- Bachelor's degree or higher in Finance, Business, Accounting or a related discipline. Additional qualifications in credit risk, risk management or compliance are advantageous.
- Minimum 5 years' experience in Australian consumer or automotive finance credit risk, gained within a captive finance company, non-bank lender or bank, including direct responsibility for credit policy development and portfolio performance.
- Strong understanding of automotive retail finance, leasing and wholesale financing, supported by sound financial analysis, portfolio monitoring and risk management capabilities.
- Practical knowledge of the National Consumer Credit Protection Act, responsible lending obligations, financial hardship requirements, AFCA, regulatory breach reporting and AML/CTF obligations.
- Experience supporting regulatory license applications or establishing compliance frameworks is highly regarded.
- Demonstrated ability to prepare clear, concise and effective reports and communications for directors, regulators and auditors.
- Ability to work independently and take a hands-on approach in a growing business, while collaborating effectively with international stakeholders.
- Ability to demonstrate the knowledge, skills and experience required to support ASIC's Responsible Manager organizational competence requirements under RG 206, together with applicable fit and proper requirements and a satisfactory regulatory history.
